Right to Information Act 2005

Historic law that ensures transparency and accountability in the administrative system

The Right to Information Act, 2005 (RTI) is a law passed by the Indian Parliament to ensure transparency and accountability in the administration. The Act gives full power to any Indian citizen to access information held by government institutions.
Main objectives
Ensuring transparency: Make the functioning of government systems transparent to the public.
Eradication of corruption: Prevent corruption by making people aware of administrative matters.
Popular participation: Empowering people in the democratic process.
Accountability: Make government officials more accountable to the people.
Application and Deadline
To whom should it be given?: Applications can be submitted to the Public Information Officers (PIOs) of each office.
Fee Structure: The normal fee is Rs. 10. Below Poverty Line (BPL) families are completely exempted from the fee.
Deadline for response:• Generally: Within 30 days
• If through Assistant PIO: Within 35 days
• If affecting life and liberty: Within 48 hours
Appeals

If the information received is not received or is incorrect, you can appeal:

First Appeal: Should be submitted to a higher official in the same office after the last date for receipt of reply or within 30 days of receipt of reply .
Second Appeal: If the first appeal is not resolved, it can be filed with the State/Central Right to Information Commission within 90 days .
Excluded information (Section 8)

There is no obligation to provide the following information for national security reasons:

  • Matters affecting the security, sovereignty, and strategic interests of the country.
  • Information that has been expressly prohibited by the courts.
  • Information received in secret from foreign countries.
  • Things that threaten the life or physical safety of individuals.
Penalties: The Act provides for a fine of Rs 250 per day, up to a maximum of Rs 25,000, to be imposed on any officer who fails to provide information or rejects an application without a valid reason .
